Nearly three weeks after a deadly fire at the “Le Constellation” bar in the Swiss ski resort of Crans-Montana, which killed 40 people and injured 116 on New Year’s Eve, authorities continue to investigate the incident amid lingering uncertainties.

Preliminary findings indicate that the fire may have been triggered by sparks from “fountain” candles that came into contact with soundproof foam installed on the basement ceiling. Questions remain about whether the establishment’s safety and fire equipment complied with regulations, as inspections had not been carried out since 2019, despite annual requirements.

The building reportedly had two exits: a basement emergency door leading to the stairwell and a staircase to the ground floor. While the emergency door was reportedly accessible and could not be locked from the inside, congestion at the main stairway may have prevented many victims from escaping. Investigators are also examining the location and condition of fire extinguishers, as it is unclear whether they were used during the blaze.

The bar’s owner, Jacques Moretti, and his wife, Jessica Moretti, are under investigation for negligent homicide, negligent bodily harm, and negligent arson. Jacques Moretti, currently in pretrial detention, may post a bail of 200,000 Swiss francs (around 215,000 euros) for release, while his wife remains free under certain restrictions. Authorities are reviewing the couple’s past legal record, which includes previous allegations in France and Switzerland.

Criticism has been raised over the handling of the investigation, particularly regarding delays in securing evidence, performing autopsies, and involving victims’ representatives. In recent days, authorities have begun seizing mobile phones, ordering autopsies, and including civil parties in proceedings. Surveillance footage from the bar’s 14 cameras could prove critical in clarifying how the fire spread.

Experts stress that transparency and strict adherence to procedural rules are essential in a case of this scale to maintain public trust in the justice system.
