Sebta: Spain Activates Exceptional Security Measures in Response to Migration Crisis

Spain has taken a new step in managing the migration crisis in Sebta. In light of the massive influx of migrants recorded at the end of July, the Spanish government has officially placed the enclave under a "national security interest situation," a mechanism aimed at enhancing the coordination of administrations and resources mobilized.

This decision was formalized by Royal Decree 681/2026, adopted following a meeting of the National Security Council and published in the Official State Bulletin. Spanish authorities justify this activation by the pressure exerted on reception, control, assistance, and administrative management capacities since the migration movements of July 30 and 31, 2026.

Enhanced Coordination Until the End of the Year

The measure concerns the entire territory of Sebta, but also the border areas, control posts, coastline, port facilities, and maritime spaces under Spanish jurisdiction.

The measure is set to remain in effect until December 31, 2026. However, it may be revised, extended, or lifted before this deadline depending on the evolution of the situation and recommendations made by the National Security Council.

For Madrid, the goal is not to establish an exceptional regime but to allow different administrations to work within a framework of enhanced coordination to preserve the continuity of essential services.

Ángel Víctor Torres Appointed to Oversee the Mechanism

The Spanish Minister of Territorial Policy and Democratic Memory, Ángel Víctor Torres, has been designated as the functional authority responsible for ensuring the coordination of the institutional response.

His mission will include organizing the use of available resources, setting common priorities, and facilitating the concerted action of the relevant administrations. The mechanism covers several dimensions of the crisis, ranging from humanitarian assistance to security, border control, administrative management, and external cooperation.

However, the usual competencies of institutions and chains of command remain unchanged. The mechanism primarily relies on better articulation of already available resources and the ability to mobilize additional resources when the situation demands.

Fundamental Rights Maintained

The decree specifies that the declaration of a "national security interest situation" does not entail the suspension of fundamental rights and freedoms.

It thus differs from the exceptional regimes provided by Spanish legislation in case of a state of alert, state of emergency, or state of siege. Authorities will continue to operate within the ordinary legal framework while benefiting from a mechanism that allows for a more coordinated response to the scale of the crisis.

A Second Decree to Mobilize Necessary Resources

A second text, Royal Decree 705/2026, has complemented this legal framework. Published on August 26, 2026, it defines the human and material resources that may be mobilized to support the implementation of the mechanism.

The two texts thus constitute the two pillars of the Spanish response: the first establishes the institutional and territorial framework for the security situation, while the second organizes the resources that can be deployed on the ground.

This sequence follows an extraordinary meeting of the National Security Council chaired on August 25 by the head of government, Pedro Sánchez, dedicated to the migration situation in Sebta.

A Response to Migration Pressure

Since the beginning of this crisis, Spanish authorities have strengthened the means dedicated to border surveillance, the reception of individuals arriving in the enclave, and the management of administrative procedures provided by legislation.

The activation of this new mechanism reflects Madrid's willingness to centralize coordination among different administrations more effectively, in a context where local capacities have been heavily strained.

The challenge now is to maintain essential services, ensure humanitarian care, enhance border control, and continue the administrative procedures related to the situation of migrants. Through this mechanism, Spain seeks to respond to a crisis that the government considers significant enough to require enhanced institutional mobilization, without transitioning into an exceptional legal regime.
