German Constitutional Court rejects blanket cancellation of Afghan admission commitments
Germany's Federal Constitutional Court has ruled that the government cannot revoke previously approved humanitarian admission commitments for Afghan nationals through a blanket decision, stating that each case must be assessed individually.

The case was brought by an Afghan mother and her two minor sons, who had been informed in 2021 that they had been accepted for relocation to Germany under the country's "human rights list" programme.
In its decision, the Constitutional Court concluded that the government's approach violated Germany's constitutional principle prohibiting arbitrary administrative action. Judges said authorities must evaluate each admission commitment on its own merits rather than applying a blanket cancellation.
Ministry's 2025 order declared arbitrary
The ruling specifically addressed an Interior Ministry directive issued in December 2025, which cancelled approximately 640 previously approved admission commitments without conducting individual assessments.
According to the court, such a collective revocation failed to respect constitutional safeguards, requiring the government to reconsider the affected cases through a case-by-case review process.
