France enacts new law allowing assisted dying under strict conditions
French President Emmanuel Macron has signed legislation establishing a legal framework for assisted dying, marking a major development in the country’s approach to end-of-life care. The measure was approved by Parliament in July and subsequently reviewed by the Constitutional Council, which found the legislation compatible with the Constitution.
The new law allows eligible adults to request assistance in dying when they are suffering from a serious and incurable illness that has reached an advanced or terminal stage. The procedure is subject to specific conditions designed to ensure that the request is made freely and with full awareness of the medical situation.
Under the legislation, patients must meet the eligibility requirements established by French law and experience severe suffering linked to an incurable condition. The framework also provides safeguards intended to prevent coercion and ensure that medical decisions are carefully assessed.
The legislation applies to adults who are either French citizens or legally established permanent residents in France. Requests for assisted dying must follow a formal process, rather than being granted automatically on the basis of a diagnosis.
The adoption of the law follows years of debate in France over patients’ rights, palliative care and personal autonomy at the end of life. Supporters argue that the measure provides greater choice and dignity to people facing unbearable suffering, while opponents have raised concerns about protecting vulnerable patients and ensuring access to high-quality palliative care.
France now joins a growing group of countries that have introduced legal frameworks allowing some form of medically assisted dying under defined circumstances. The implementation of the new system is expected to remain closely watched as healthcare professionals and public authorities establish the procedures required by the legislation.
