How important is integration when applying for Spanish citizenship through residency? Foreigners seeking to obtain Spanish nationality must demonstrate their efforts to integrate into Spanish society. This requirement raises questions about what constitutes genuine integration and how it is assessed.

Many expatriates, particularly from the UK, often find themselves in communities where English predominates, socializing primarily with fellow English speakers and relying on English-speaking services. In some Spanish villages, foreigners can even outnumber locals. This phenomenon is not limited to UK nationals; expatriates from various nations frequently cluster together, whether intentionally or otherwise.

For those who wish to acquire Spanish nationality after ten years of residency, proving integration becomes crucial. The challenge lies in determining how integration is evidenced and whether failure to do so can lead to citizenship denial.

The application process for Spanish nationality

Recently, several foreigners have faced citizenship application rejections due to insufficient proof of integration, including individuals from Romania, Bolivia, and Morocco. While integration was not the sole reason for their denials, it played a significant role.

The Spanish authorities rely on clearly defined criteria to assess integration. According to the government, "accreditation for integration is highly objective," primarily through passing tests administered by the Cervantes Institute.

The first assessment is the DELE language exam, which requires candidates to demonstrate at least an A2 proficiency level in Spanish. This exam evaluates reading, listening, and speaking skills. The second is the CCSE exam, which tests knowledge of Spanish culture, geography, politics, and history. Candidates must correctly answer 15 out of 25 questions to pass.

Notably, nationals from Ibero-American countries are exempt from the language tests. Other exemptions apply to minors under 18, individuals with learning disabilities, those who are illiterate, and Sephardic Jews over 70 years old. For everyone else, passing both tests is essential to prove integration.

Controversies surrounding the tests

Despite the structured approach, not all agree that these exams adequately reflect integration. Critics argue that the tests can be discriminatory and contradict the principle of equality enshrined in the Spanish constitution. This issue became particularly salient in cases involving migrant women with varying educational backgrounds, which even reached the Supreme Court.

The court ruled that discrimination based on sex could not be justified but acknowledged the need for flexibility in evaluating applicants' circumstances. It recommended that the requirements for language and cultural knowledge be adjusted based on individual educational levels and other relevant factors.

Gema Murciano, Co-director of Sepín Immigration Law Firm, emphasizes that a one-size-fits-all approach to integration is inadequate. She advocates for a more individualized assessment, considering candidates' unique backgrounds and challenges.

 

In summary, while failure to demonstrate integration can indeed result in citizenship denial—especially if applicants do not pass the language and cultural exams—each case may be evaluated on its own merits, particularly for those in vulnerable situations. Therefore, understanding and navigating the integration process is vital for those seeking to secure Spanish nationality.
