The impartiality of an inquiry into allegations of sexual misconduct against the chief prosecutor of the International Criminal Court (ICC) is being questioned due to concerns about his connections to the agency overseeing the investigation. These concerns, raised by ICC staff, highlight potential conflicts of interest stemming from professional ties between the prosecutor and key figures within the investigative body.

Allegations and Controversies Surrounding the Chief Prosecutor  


Karim Khan, the ICC’s chief prosecutor, faces allegations of unwanted sexual touching, coercive behavior, and abuse of authority. His legal team denies these claims, expressing his willingness to cooperate fully with the investigation. The alleged victim, a staff member in her 30s who worked directly with Khan, has indicated her readiness to participate, provided the inquiry is conducted independently.  

Several ICC staff members have voiced dissatisfaction with Khan’s decision to remain in his position during the inquiry, suggesting it could undermine the investigation's integrity and deter potential witnesses. Calls have been made for him to temporarily step aside to avoid influencing the process.

The inquiry is reportedly being handled by an external agency, with speculation pointing to the Office of Internal Oversight Services (OIOS). However, questions have been raised regarding Khan's links to this UN-affiliated watchdog. His wife, a human rights lawyer and former OIOS investigator, has been cited as a key figure in this controversy. Allegations have surfaced that she acted inappropriately by contacting the alleged victim and others involved shortly after the claims were reported.  

Khan’s past professional relationship with a senior OIOS investigator has also drawn scrutiny. This individual, who previously worked closely with Khan at a UN body addressing crimes committed by the Islamic State, may hold a significant role in the current investigation. These overlapping connections have fueled concerns about the potential for bias or conflicts of interest.

 Official Responses and Developments  


The ICC’s governing body, the Assembly of State Parties, announced the initiation of an independent external inquiry, acknowledging the necessity of avoiding perceived conflicts of interest. Diplomatic sources indicate ongoing discussions with the OIOS to finalize the framework for this investigation.  

Despite the controversies, some stakeholders believe the OIOS has mechanisms to ensure impartiality. Others, however, remain skeptical, emphasizing the importance of safeguarding the credibility of the inquiry during this critical moment for the ICC.

 Broader Implications  


The investigation comes as the ICC confronts significant geopolitical challenges, including high-profile cases related to alleged war crimes in Gaza. Khan has suggested the allegations may be part of broader efforts to undermine his position. However, sources close to him reportedly dismiss the notion that external actors orchestrated the claims.
