South Korean court reinstates impeached PM Han Duck-soo as acting president

South Korea’s Constitutional Court has reinstated impeached Prime Minister Han Duck-soo as acting president, adding another chapter to the country’s ongoing political turmoil following the impeachment of President Yoon Suk-yeol.

In a 7-1 ruling, the court’s eight justices dismissed Han’s impeachment on Monday, allowing him to resume his role while the court continues to deliberate Yoon’s fate. Five judges determined there was insufficient justification for Han’s removal, although they acknowledged that the impeachment motion against him was procedurally valid. Two justices argued that the motion lacked legitimacy, as it had only been supported by 192 of 300 lawmakers, falling short of the required two-thirds majority.

Han was appointed acting president on December 14 after Yoon’s impeachment but was suspended less than two weeks later due to his refusal to appoint three additional Constitutional Court justices. Following the court’s decision, Han delivered a televised address, thanking the justices for their “wise decision” and pledging to address South Korea’s pressing geopolitical challenges.

“I believe the people are clearly rejecting extreme political polarization. Now is not the time for division—our nation must move forward,” Han stated.

Meanwhile, the court has yet to determine whether Yoon’s impeachment will be upheld or if he will regain his presidential powers. A final ruling is expected within days, as at least six of the eight justices must vote in favor of Yoon’s removal for it to take effect. If his impeachment is confirmed, South Korea will hold a presidential election within 60 days to elect his successor.

Yoon is also facing separate criminal charges, including insurrection, for his brief imposition of martial law on December 3. If convicted, he could face life imprisonment or the death penalty.
