The conflict surrounding the Panama Canal's port infrastructure has taken on a new judicial dimension. Hong Kong-based group CK Hutchison is initiating arbitration proceedings against the Panamanian state, claiming over $1.5 billion following the loss of its concession amid rising tensions between Washington and Beijing.

A Financial Battle Amid Geopolitical Rivalry

The Panama Canal case has reached a new level. CK Hutchison has announced the launch of arbitration proceedings against Panama, contesting the measures that led to the termination of its operation of two strategic port infrastructures.

The Hong Kong group is claiming over $1.5 billion for investments it believes it has lost. Its approach is based on the provisions of a treaty designed to protect foreign investments.

Behind this commercial dispute lies a much larger issue. The presence of a Hong Kong group in facilities located at both ends of the canal has become particularly sensitive amid economic and strategic competition between China and the United States.

Two Strategic Ports at the Heart of the Dispute

The subsidiary Panama Ports Company (PPC) has operated the ports of Balboa and Cristóbal since 1997. The former is located at the Pacific entrance of the canal, while the latter is situated on the Atlantic side.

These infrastructures occupy a strategic position on one of the world's main maritime routes. The Panama Canal alone facilitates a significant portion of international trade, which gives its port facilities an economic importance that far exceeds the Panamanian market.

In January 2026, the Supreme Court of Panama annulled the concession granted to PPC. This decision resulted in CK Hutchison losing control of these two ports and opened a new phase of confrontation between the company and Panamanian authorities.

CK Hutchison Cites Investment Protection

For the Hong Kong group, the end of the concession is not merely an administrative or judicial decision. CK Hutchison believes that the measures taken by Panama have violated the guarantees provided by the applicable investment protection treaty.

The company claims it intends to utilize all legal mechanisms at its disposal to defend its interests. The arbitration procedure has now become the main lever of this strategy.

The amount being claimed, exceeding $1.5 billion, adds a significant financial dimension to the dispute. However, this sum will need to be examined within the context of the proceedings and does not predetermine the outcome of the arbitration.

Washington and Beijing in the Background

The dispute arises as the Panama Canal is at the center of heightened geopolitical attention. The presence of interests linked to Hong Kong in essential infrastructures has fueled American concerns about Chinese influence surrounding this maritime route.

For Panama, the issue of control and operation of the canal's infrastructures directly touches on its sovereignty and strategic interests. For CK Hutchison, the stakes now revolve around the protection of capital invested for nearly three decades.

This confrontation illustrates how port infrastructures can become friction points between commercial interests, national sovereignty, and rivalries among major powers.

A Case Now in Arbitration

CK Hutchison also asserts its desire to reach a negotiated solution with Panama. However, by initiating arbitration proceedings, the group aims to preserve all its rights and remedies provided by international texts.

The case could therefore extend over time. Beyond the amount claimed, its outcome could also influence the perception of risk related to foreign investments in Panama's strategic infrastructures.

The dispute surrounding Balboa and Cristóbal thus transcends the mere relationship between a state and a port operator. It now represents a new episode in a battle where global trade, international law, and geopolitical rivalry intersect around one of the planet's most strategic maritime passages.
