Morocco Recovers Over $7 Million in Misappropriated Public Funds

Morocco's National Judicial Agency, a stalwart guardian of state finances since its establishment in 1928, has announced the recovery of a staggering $7.2 million in misappropriated public funds during the fiscal year 2022. This achievement underscores the agency's unwavering commitment to safeguarding the nation's financial integrity and ensuring accountability for those who mishandle public resources.

With a longstanding mandate to protect state finances, the National Judicial Agency wields the authority to reclaim expenses paid by the state to its employees under the Civil and Military Pensions Laws. This power enables the agency to seek reimbursement from individuals responsible for accidents, particularly traffic incidents, as well as from insurance companies covering these damages.

In addition to court-ordered recoveries, the agency reported securing an additional $151,000 through amicable settlements with insurance companies, further bolstering the state's coffers. The agency's tireless efforts have yielded remarkable results, with approximately $315 million saved to the state treasury in 2022 alone, a testament to the agency's efficacy and diligence.

Moreover, the agency's impact extends beyond the fiscal year, with savings reaching an impressive $1.6 billion between 2018 and 2022, showcasing a sustained commitment to fiscal prudence and accountability. The agency's efforts have not been limited to recouping funds; it has also managed to transfer $151,000 back to the state treasury, originating from expenses paid to employees under the pension systems.

In addition to these financial recoveries, the agency secured court rulings with a financial impact of $200,000, including legal interest, further solidifying its role as a bulwark against financial misappropriation. Enforcement procedures for these final and enforceable judgments are currently underway, ensuring that justice prevails and misappropriated funds are rightfully returned to the state's coffers.

While Morocco has taken legal measures to criminalize embezzlement, a review report by the United Nations Office on Drugs and Crime (UNODC) spanning 2010 to 2015 revealed that penalties for embezzlement in the Moroccan private sector were deemed "lenient," potentially limiting their deterrent effect. This finding underscores the agency's vital role in upholding financial integrity and serving as a formidable deterrent against financial misconduct.
