Prosecutor defends amnesty for Puigdemont and rejects economic motive in independence case

The Spanish Public Prosecutor's Office argues that former Catalan president Carles Puigdemont did not seek financial gain through the illegal independence referendum of 2017, and that the embezzlement charges he still faces are subject to amnesty. This defense was presented during a public hearing at the Supreme Court on Monday to review Puigdemont’s and former ministers Toni Comín and Lluís Puig’s appeal against the ruling of Judge Pablo Llarena, which was supported by the Criminal Chamber, denying the application of amnesty.

The Appeal Court held the hearing at the request of Puigdemont's lawyer, Gonzalo Boye, and listened to arguments from both the defense of Puigdemont and the other defendants, as well as from the popular accusation represented by Vox, the State Attorney's Office, and Deputy Prosecutor María Ángeles Sánchez Conde. All parties, except Vox, supported the view that the embezzlement charge still under investigation by Llarena falls within the scope of amnesty eligibility. After considering the arguments presented by all sides, the panel of judges, consisting of Eduardo Porres, Susana Polo, and Vicente Magro, will decide whether to uphold the appeal.

Should the court reject the appeal, the defense teams of the separatists could appeal to the Constitutional Court, claiming a violation of their fundamental rights.
