Morocco accelerates implementation of alternative sentencing law

The General Delegation for Prison Administration and Reintegration (DGAPR) has firmly rejected recent reports suggesting delays in the implementation of Law 43.22 on alternative sentences. In a statement, the DGAPR clarified that significant progress has been made to ensure the law’s effective application.

Mobilization of resources and training

The DGAPR detailed its extensive preparations, which include mobilizing resources at both the central and regional levels. Specialized staff have been assigned and trained to oversee the new measures, ensuring that cases are handled in accordance with the law's requirements.

Deployment of electronic monitoring

A national platform for electronic monitoring has been established, meeting the deadlines set by the government. Electronic bracelets, a key component of this reform, are now operational to provide real-time supervision for individuals serving alternative sentences under this measure.

Coordination with government sectors

The DGAPR acknowledged that the timing of the law’s entry into force coincided with the summer holidays, which temporarily delayed its immediate application. However, the institution emphasized its ongoing efforts to coordinate with other government sectors to ensure a seamless rollout of the reform.

Judicial alignment with the new law

The Supreme Council of Judicial Power (CSPJ) has instructed courts across Morocco to actively enforce the law. Court presidents have been directed to appoint judges specializing in alternative sentencing and issue rulings that specify both the original prison term and the substitute penalty.

A transformative reform for Morocco’s justice system

The adoption of Law 43.22 represents a significant shift in Morocco’s justice system. By promoting rehabilitation and reintegration, the reform aims to reduce the economic and social costs of traditional imprisonment. With the law officially in effect, the DGAPR and judicial authorities are working to ensure its full and proper implementation in the coming days.
