Moroccan Family Code Revision: A Comprehensive Overview of the Public Consultation Process with Over 130 Submissions

With the conclusion of the public consultation, Morocco's crucial revision of its Family Code has witnessed substantial input from citizens and advocacy groups. Over 130 hearings were conducted by the Special Committee tasked with reviewing the Moudawana, as reported by Committee Head Hassan Dakki.

Dakki shared an update on the consultation process, highlighting the collaborative nature of the discussions. The participants included 12 professional bodies, eight family-focused NGOs, and 13 research centers. Dakki expressed the committee's openness, encouraging additional written opinions on the code's reform through their website.

Initiated by King Mohammed VI in September, the code's review entrusted Prime Minister Aziz Akhannouch with delivering draft recommendations within six months.

Among the proposed changes, advocates for women's rights are advocating for the prohibition of polygamy and equal inheritance rights irrespective of gender. Currently, the code permits underage marriage and exhibits gender bias in inheritance laws.

The consultations witnessed contributions from the Women’s Coordination coalition, comprising 31 women's rights groups. They emphasized the importance of precise legal wording to prevent ambiguity and ensure the inclusive and comprehensive nature of the reform.

As the nation awaits parliamentary approval, Moroccans are optimistic that the special committee's inclusive process will yield recommendations safeguarding the freedoms and rights of all citizens under the Family Code. With the analysis of over 130 submissions, Morocco stands on the cusp of embracing progressive changes.
