EU court confirms Google fine over illegal gambling advertising on YouTube
The European Union’s highest court has upheld a €750,000 ($854,250) fine imposed on Google by Italian regulators over gambling-related advertising displayed on its YouTube platform, strengthening the legal responsibility of major digital platforms for content shared through commercial partnerships.
The ruling, delivered on Thursday by the Court of Justice of the European Union, confirmed the decision taken by Italy’s communications authority against Google’s parent company Alphabet Inc..
The case focused on promotional gambling content published by a YouTube creator who had a commercial relationship with Google. The court determined that the technology company could be held accountable for videos produced within such partnerships.
Court expands platform responsibility for partner content
In its decision, the European court stated that Google may be considered responsible for videos created by content producers when a commercial partnership exists between the platform and the creator.
The ruling highlights the growing scrutiny faced by online platforms as European regulators seek to establish clearer obligations for companies hosting user-generated content. Authorities across the region have increasingly focused on how technology companies monitor advertising practices and protect users from restricted or harmful promotions.
Italy’s crackdown on gambling promotion
The Italian communications regulator imposed the financial penalty several years ago after identifying gambling-related advertising activity linked to YouTube content. Italy has adopted strict rules limiting gambling promotion as part of broader efforts to reduce exposure to betting advertisements.
Google had challenged the sanction, arguing that it should not be held responsible for content created by independent users on its platform. However, EU judges rejected that argument in cases involving commercial cooperation between the platform and content creators.
A significant ruling for digital advertising regulation
The decision could influence future disputes involving online platforms, influencers, and advertisers across Europe. As digital advertising ecosystems become increasingly complex, regulators are examining whether technology companies should play a greater role in supervising commercial content distributed through their services.
The ruling comes at a time when major technology groups face mounting regulatory pressure in Europe over issues ranging from competition rules to online safety and advertising transparency.
