OpenAI loses trademark appeal for its name in the European Union
OpenAI, the American company behind ChatGPT, has lost its latest appeal to register its name as a trademark in the European Union, following a ruling that the term lacks the distinctiveness required under EU trademark law.
The dispute centers on the company’s attempt to secure exclusive trademark rights for the name "OpenAI." While European authorities previously accepted the registration of the company's logo, they declined to register the name itself, arguing that it consists of common descriptive words that could be widely used within the artificial intelligence sector.
According to European intellectual property rules, names that merely describe the nature or characteristics of products and services cannot normally receive trademark protection. The objective is to prevent businesses from obtaining exclusive rights over generic expressions that competitors may legitimately need to use in their own commercial activities.
OpenAI challenged the decision through the European legal system, seeking to overturn the ruling. However, the court upheld the earlier decisions, concluding that the company had not demonstrated that the name possessed sufficient distinctive character to qualify for trademark registration across the European Union.
The decision does not prevent OpenAI from operating or offering its products within Europe. Instead, it limits the company's ability to claim exclusive trademark rights over the name itself under EU law. Its visual branding, including registered logos, remains protected where applicable.
Trademark disputes involving technology companies have become increasingly common as the artificial intelligence industry expands rapidly. Businesses are seeking stronger protection for their brands while regulators continue to balance intellectual property rights with fair competition and the public interest.
The ruling highlights the strict standards applied by European intellectual property authorities when assessing trademark applications, particularly in fast-growing industries where descriptive terms are frequently used by multiple market participants.
