Morocco enacts criminal procedure reform to modernize justice system

Morocco’s Ministry of Justice announced that Law No. 03-23, amending the Code of Criminal Procedure, officially came into force on September 8 following its publication in the Official Bulletin. This reform is being hailed as a transformative step in strengthening the rule of law, modernizing the judicial system, and aligning with Morocco’s broader development goals.

A commitment to justice and democracy

In its statement, the Ministry emphasized that the reform stems from Royal Directives advocating for a modern penal policy and a fair, effective justice system. It also draws upon the spirit of the 2011 Constitution, which enshrines the protection of fundamental rights and freedoms as integral to Morocco’s democratic framework.

Strengthening fair trial guarantees

The new law enhances protections for defendants by reinforcing the presumption of innocence, ensuring the right to timely judgments, and expanding access to legal aid. Stricter oversight of pre-trial detention has also been introduced, requiring judges to justify incarceration decisions and encouraging alternative measures.

Additionally, the law strengthens rights during police custody by mandating that suspects be informed of their rights, granting access to legal counsel, and providing interpreters when necessary.

Expanding victims' protections

The legislation also prioritizes victims’ rights, ensuring they are informed throughout legal proceedings and provided with legal and social support. Special provisions address the needs of vulnerable groups, including women and children who are survivors of violence. Another key feature of the reform is the creation of a National Observatory of Criminality, which will use scientific data to guide penal policy.

A cornerstone of national reform

Justice Minister Abdellatif Ouahbi described the legislation as a cornerstone of Morocco’s broader reform project. He noted that the law reflects the state’s commitment to democracy, legal transparency, and sustainable development.

Ouahbi also emphasized that the criminal procedure reform is tied to Morocco’s preparations for significant milestones, including hosting the 2030 FIFA World Cup. A modern judicial framework, he said, is essential for ensuring legal security and enhancing Morocco’s international appeal.

Part of a broader agenda

The adoption of Law No. 03-23 is part of a wider justice reform agenda encompassing revisions to the Penal Code, modernization of legal professions, and accelerated digital transformation of court systems. These efforts align with the New Development Model for 2030, which outlines Morocco’s vision for sustainable growth and institutional modernization.

The Ministry of Justice underscored that this long-term project is positioning Morocco as a regional leader in judicial reform and a model for legal modernization on the international stage.
