USA: Suspension of tariffs invalidated by the Supreme Court from Tuesday
The U.S. Customs and Border Protection (CBP) announced that it will suspend, starting Tuesday, the collection of tariffs recently invalidated by the Supreme Court of the United States, according to an internal notice released on Sunday.
The agency specified that duties imposed under emergency economic powers will no longer be enforced or collected as of February 24, 2026. The suspension applies exclusively to tariffs enacted under the International Emergency Economic Powers Act (IEEPA) and does not affect other existing customs duties.
The ruling by the Supreme Court determined that the tariffs introduced in 2025 by U.S. President Donald Trump were unlawful under American law. A majority of justices concluded that the emergency powers framework had been used beyond its intended scope, allowing for unilateral and potentially unlimited tariff measures without congressional approval.
In response to the decision, the president criticized the court’s judgment and signaled further adjustments to global tariff rates, announcing an increase shortly after the ruling. The reaction reflects ongoing tensions between the executive branch and judicial authorities over the scope of economic powers in trade policy.
