The crux of the complaint centers on allegations that Harris's campaign violated federal campaign finance laws by assuming control of Joe Biden's campaign funds following his unexpected withdrawal from the race.

The complaint, filed by Trump's campaign general counsel David Warrington, contends that the Biden campaign's decision to rename its committee from "Biden for President" to "Harris for President" and transfer approximately $91 million in funds is unlawful. Warrington argues that this maneuver amounts to "little more than a thinly veiled $91.5 million excessive contribution from one presidential candidate to another."

The Trump campaign's legal team asserts that federal regulations prohibit candidates from retaining contributions for elections in which they do not participate. The complaint states, "Biden for President 2024 has shown no intention to properly refund or re-designate the general election funds it has already received. This makes them all excess contributions."

While the FEC's response to this complaint remains uncertain, it is clear that the Trump campaign is employing various tactics to impede the momentum Harris has gained since becoming the presumptive Democratic nominee. A spokesperson for the campaign pointed out that the Biden-Harris committees have always been authorized for either Biden or Harris. They also highlighted the campaign's impressive fundraising efforts, noting that they had raised $100 million in donations within 36 hours of Biden's withdrawal from the race.

"Baseless legal claims – like the ones they've made for years to try to suppress votes and steal elections – will only distract them," the Harris campaign stated, taking a swipe at Trump's past legal challenges to election results.

The complaint further argues that Harris's takeover of Biden's remaining campaign funds constitutes an excessive unlawful contribution, as "Biden for President" was not an authorized committee for the Harris campaign. It contends that if Biden is not seeking the Democratic Party's nomination, he will not participate in the general election, making all general election contributions received by his campaign excessive and in need of disposal.
