Swiss Supreme Court upholds legality of Gaza protest coverage

Switzerland’s Federal Supreme Court has overturned an earlier ruling against the German-language Swiss public broadcaster SRF over its reporting on pro-Gaza university protests held across the country in 2024.

The dispute dates back to December 2024, when Switzerland’s Independent Complaints Authority for Radio and Television criticized SRF’s coverage, arguing that its reports presented a one-sided account of the demonstrations. The complaint alleged that the broadcaster had downplayed certain incidents during the protests and had failed to give sufficient attention to allegations of antisemitism.

The Federal Supreme Court has now rejected those findings, emphasizing that a violation of the principle of pluralism can only be established when essential aspects of an issue are systematically and deliberately excluded from media coverage.

In reviewing SRF’s reporting, the court found that allegations of antisemitism had in fact been addressed through different programs and editorial formats. On that basis, the judges concluded that the broadcaster’s coverage remained within the legal framework governing public-service media in Switzerland.

The case originated from a complaint filed by an individual against the broadcaster. The Supreme Court ultimately upheld an appeal submitted by SRG, the parent organization of Swiss public broadcasting, which also operates the international platform Swissinfo.

The ruling highlights the legal standards applied to public broadcasters when covering politically sensitive and socially divisive issues. It also underlines the distinction between editorial choices and a legally established failure to provide pluralistic coverage.

The decision comes amid continued debate in Europe over media coverage of the war in Gaza, demonstrations supporting Palestinians and allegations of antisemitism, placing particular importance on the balance between editorial independence, comprehensive reporting and legal requirements for public broadcasters.
