In a striking blow to the integrity of the judicial system, a federal judge in Alaska has tendered his resignation following a damning investigation that uncovered a pattern of inappropriate behavior and ethical breaches. U.S. District Judge Joshua M. Kindred, a nominee of former President Donald Trump, stepped down on Monday after the Judicial Council of the 9th Circuit urged him to resign voluntarily in the wake of disturbing allegations.
The 30-page court order, released to the public on Monday, paints a troubling picture of Kindred's conduct, which included engaging in an "inappropriately sexualized relationship" with a law clerk that extended briefly into her tenure as an assistant U.S. attorney in Alaska. The allegations, initially brought to light in 2022, prompted Chief Circuit Judge Mary H. Murguia to appoint a special committee to investigate Kindred's actions.
In a scathing assessment, the council concluded that "Judge Kindred's misconduct was pervasive and abusive, constituted sexual harassment, and fostered a hostile work environment that took a personal and professional toll on multiple clerks." The order cited specific instances of egregious behavior, including an incident in October 2022 where Kindred allegedly kissed a former law clerk and groped her after inviting her for drinks shortly after her clerkship ended.
Another disturbing allegation involved Kindred purportedly "putting his hands on" the law clerk and performing oral sex on her after persuading her to join him at an associate's apartment. The order also referenced interviews with Kindred's clerks and judiciary employees, as well as hundreds of pages of text messages that exposed his inappropriate conduct, including discussions about his dating life, disparaging remarks about colleagues, and encouragement to rate people based on their "f---ability."
The investigative report further alleged that Kindred made false statements and obstructed the proceedings, prompting him to acknowledge in a written response that he had "failed to exercise appropriate boundaries and crossed lines I should not have crossed." However, he maintained that his relationship with the law clerk "was not something that was born out of something sinister."
In the wake of these revelations, Kindred submitted his resignation to President Joe Biden last week, effective Monday. The decision was met with a statement from Chief Circuit Judge Murguia, who emphasized the judiciary's commitment to "promoting a civil and respectful workplace, free of discrimination and harassment, and maintaining the integrity of the Judiciary."
The resignation has also drawn attention from Alaska's political circles, with Senator Lisa Murkowski, a Republican, expressing her support for Kindred's departure, stating, "Judges need to be held to the highest of standards, and Mr. Kindred fell well short of that mark."
