Syria sentences ousted president Bashar al-Assad to death in absentia

A Syrian court has sentenced former president Bashar al-Assad to death in absentia, marking one of the most consequential judicial actions taken by the country's transitional authorities since the fall of his government.

The ruling, issued on Tuesday, holds Assad responsible for crimes committed during the Syrian conflict that erupted in 2011. The former president was convicted of war crimes and crimes against humanity, according to the information released about the proceedings.

Assad was not present in court. He fled Syria with members of his family after opposition forces captured Damascus in December 2024. He subsequently took refuge in Moscow.

Former security official also sentenced to death

The case also resulted in a death sentence for Atef Najib, a former political security chief in Deraa. Unlike Assad, Najib was present when the sentence was handed down.

The proceedings represent an early effort by Syria's transitional authorities to hold senior figures from the former government accountable through the country's judicial system.

Najib had previously held a prominent security position in Deraa, the southern city widely associated with the early stages of the uprising that developed into Syria's devastating civil war.

A landmark case for Syria's transition

The death sentence against Assad carries particular political and symbolic significance. For years, the former president remained at the center of Syria's political system as the conflict expanded into a prolonged war involving domestic opposition groups, jihadist organizations and foreign powers.

His departure from Damascus in late 2024 brought an abrupt end to his rule and opened a new, uncertain period for the country. The transitional authorities now face the challenge of addressing allegations of abuses committed under the former government while attempting to establish new institutions.

The prosecution of figures linked to the previous administration could become a defining element of that transition. The Assad case, in particular, places questions of accountability, justice and the treatment of former regime officials at the heart of Syria's post-war political landscape.

Assad's exile complicates enforcement

Because Assad is living in Moscow, the sentence cannot be immediately enforced. His absence from the proceedings underscores the gap between judicial decisions made inside Syria and the country's ability to bring former senior officials back before its courts.

His presence in Russia also gives the case an international dimension. Any attempt to enforce the ruling would depend on circumstances far beyond the Syrian judicial system.

For Syria's new authorities, however, the verdict sends a clear message: the legacy of the former government is increasingly being addressed through formal legal proceedings rather than solely through political measures.
