Real estate acts now require local registry inscription in Morocco

The inscription of real estate acts in a local registry has become a mandatory legal condition in Morocco following a new administrative circular issued on June 5, 2026 by the national land conservation authority. The measure establishes that no document creating or transferring real property rights can produce legal effect unless it is recorded in the designated registry, including agreements signed before the system was introduced.

The new framework changes the legal weight of property documentation. Notaries, lawyers, judges and land administration officials must now verify that any act affecting real estate rights has been properly registered. Requests to cancel, modify or challenge earlier transactions must include a certified extract from the local registry, in line with the official procedural model set in September 2025. Without this document, administrative services are instructed to reject applications.

The reform marks a shift in the legal function of registration. Previously, registration served mainly fiscal and evidentiary purposes. It is now a condition for enforceability. A contract may exist between parties but lose legal effect against third parties if it is not entered into the registry. This change strengthens the central role of the registry in Morocco’s property system and increases its weight in determining ownership rights.

The transition is expected to affect ongoing disputes and routine transactions. Inheritance partitions, unfinalized sales agreements and unregistered easements may face administrative blocking or judicial rejection. Surveying professionals involved in land title procedures will also need to adapt to the new requirements when updating property rights.

Questions are emerging over the retroactive scope of the measure. Acts concluded before June 2026 are also subject to the requirement, even though the current registry system was not fully operational at that time. This raises concerns about the regularization of older files and the processing of pending cases within courts and land administration offices.
