Morocco reduces pre-trial detention rates to historic low

Morocco has achieved a groundbreaking milestone in its judicial system by reducing pre-trial detainees to less than 30% of the total prison population during specific periods. This achievement, described as historic by the country’s chief public prosecutor, reflects a significant improvement in the coordination of judicial bodies.

Prosecutor General Hicham Balaoui announced the development in a circular issued yesterday, highlighting the efforts of local and regional commissions tasked with monitoring pre-trial detention. “Morocco managed to reduce pre-trial detention rates to under 30% of the prison population, a level never reached before in previous years,” Balaoui stated.

Challenges and risks remain

Despite the progress, Balaoui acknowledged the fragility of the situation. Historical data shows a recurring increase in pre-trial detention rates during summer due to judicial staff shortages. Delayed hearings and extended detention periods often arise during the holiday season, creating risks of backlogs.

To mitigate these challenges, Balaoui called for early planning and closer cooperation between prosecutors and court leadership. He emphasized the importance of protecting public order and individual liberty while maintaining the progress achieved.

Shifting the approach to pre-trial detention

The circular outlined a clear directive for prosecutors: pre-trial detention must be treated as an exception rather than a routine measure. Balaoui urged a more responsible and deliberate approach to strengthen public trust in the judiciary. He also advocated for increased reliance on legal alternatives and restorative justice, aligning with earlier reforms.

Prosecutors were instructed to ensure detainees appear in court promptly and to collaborate closely with presiding judges to process cases efficiently. Balaoui also reminded judicial authorities to consistently monitor pre-trial detention cases and intervene quickly in case of delays or obstacles. Prosecutors were urged to notify the Public Prosecution headquarters immediately if challenges arise in implementing the directive.

This judicial reform represents a significant step toward a more balanced and fair justice system in Morocco, emphasizing individual rights and public trust.
