Morocco court clarifies rules on home video surveillance use
A ruling from Morocco’s highest court has set clearer boundaries on the use of home surveillance cameras, confirming that residents may install security systems to protect their property and family, provided they do not violate the privacy of others.
The decision stems from a civil dispute in Casablanca involving a tenant living on the ground floor of a villa in Aïn Diab and the property owners. The tenant challenged the installation of surveillance cameras, arguing that their positioning allowed visibility into his living space and constituted an intrusion into his private life. He also requested the removal of a metal gate, claiming it restricted access to his garage.
The property owners defended the installation, stating that the cameras were placed strictly for security purposes. They said the system was designed to monitor entrances, access points, and shared circulation areas within the property. They rejected any claim that the equipment was intended to record private areas belonging to the tenant or interfere with his daily life.
The court confirmed that protecting private property is a legitimate right and that surveillance systems can be justified when used for prevention and security. It also established a key limitation. Cameras must remain strictly oriented toward necessary security zones. Monitoring entrances, gates, and exterior access points is considered lawful. Recording private living spaces, windows, terraces, or enclosed personal areas belonging to others may constitute a violation of privacy rights.
The ruling provides practical guidance for homeowners and tenants facing similar disputes. It reinforces a legal balance between two principles. Individuals have the right to secure their homes against intrusion and damage. At the same time, that protection cannot extend into surveillance that affects the intimate spaces of others living on or near the same property.
