ICC prosecutor Karim Khan remains suspended after losing appeal with UK legal regulator

International Criminal Court (ICC) chief prosecutor Karim Khan has failed in his attempt to overturn an interim suspension imposed by the United Kingdom’s legal regulator, prolonging uncertainty around the leadership of the world’s main permanent court for war crimes.

The Bar Standards Board announced on Tuesday that Khan’s appeal against the suspension had been rejected. The decision means he remains temporarily barred from practicing as a barrister while allegations of sexual misconduct against him are examined.

Khan, a 56-year-old British lawyer, has denied the accusations.

Legal and institutional crisis deepens

The ruling adds another layer to the crisis surrounding the ICC, which had already suspended Khan from his role on June 8 following action by the court’s governing body.

The situation comes at a particularly sensitive time for the institution, which is facing significant political pressure and operational challenges. The court has also been affected by sanctions imposed by the United States linked to its investigations involving American and Israeli officials.

Supporters cite political pressure

Khan’s supporters have argued that the allegations against him emerged in a highly charged political context, pointing to his office’s decision to seek arrest warrants for Israeli officials over Israel’s conduct during the war in Gaza.

They have claimed that the prosecutor has become a target because of the ICC’s investigations and decisions involving powerful states and international actors.

Critics, however, have emphasized the importance of allowing independent procedures to examine the allegations and determine the appropriate outcome.

ICC role in international justice

Established in 2002, the International Criminal Court was created to prosecute individuals accused of genocide, crimes against humanity and war crimes committed by nationals of member states or on the territory of countries under its jurisdiction.

Based in The Hague, the court has long been at the center of debates over accountability, state sovereignty and the challenges of enforcing international law.

The continuation of Khan’s suspension leaves questions over the future direction of the prosecutor’s office as the ICC navigates one of the most significant leadership challenges in its history.
